Terms of Service

Platform Notice: Social Additions is an evolving platform. These Terms of Service, along with all policies, features, fees, and platform functionality, are subject to change at any time. By continuing to use the platform, you acknowledge that terms may be updated without prior notice. We are actively improving — thank you for being part of our early community.
Important — Independent Contractor Notice: All individuals listed in the Social Additions directory are Independent Contractors. They are self-employed professionals who operate independently and are not employees, agents, staff, representatives, or contractors of MCC Network LLC or Social Additions in any capacity. Social Additions does not employ, direct, supervise, or control any listed individual. All booking arrangements, rates, availability, and engagement terms are set by and agreed to solely between the Client Member and the Independent Contractor directly. Social Additions is a connection platform only.
Fees & Refunds: Platform service fees, membership fees, and subscription charges are non-refundable. Booking cancellation refunds are subject to the cancellation policy outlined in Section 12. By completing any payment, you acknowledge and agree to these terms.
1. About Social Additions
MCC Network LLC, doing business as Social Additions ("Social Additions," "we," "us," "our") operates a social hosting marketplace, directory, and gig board at socialadditions.com. We connect Client Members seeking social experiences with ID verified independent Social Ambassadors offering their time and company for lawful social, event, professional, and lifestyle engagements.
Social Additions is a neutral marketplace, directory, and connection platform — not an agency, staffing firm, talent management company, employer, or booking agent. We provide the infrastructure and tools for connection. The specific terms of any booking, event, or gig engagement are agreed to directly and solely between the Client Member and the Social Ambassador. Social Additions is not a party to those agreements.
By creating an account, accessing the platform, submitting an application, posting a gig, or using any feature of Social Additions, you agree to be bound by these Terms of Service and all policies incorporated by reference, including our Privacy Policy, Community Guidelines, and Rules, Reporting & Enforcement. If you do not agree, you must stop using the platform immediately and close any account.
2. What Social Additions Is Not
Social Additions is exclusively a platform for lawful, platonic social hosting. To be unambiguous:
- ✕Social Additions is not a dating platform, escort service, or companion-for-hire service involving sexual, romantic, or adult-only activity of any kind.
- ✕Social Additions does not facilitate, broker, market, advertise, or promote sex work, prostitution, erotic services, paid intimacy, or any sexual or romantic conduct of any kind, whether legal or illegal in any jurisdiction.
- ✕Social Additions is not an employer. Social Ambassadors are independent contractors who set their own rates, schedules, availability, and personal limits. No employment relationship exists between Social Ambassador and Social Additions.
- ✕Social Additions is not an employment agency. Posting or responding to a Gig Board listing does not create an employment relationship with Social Additions or any other party.
- ✕Social Additions does not guarantee the character, suitability, qualifications, legal status, or conduct of any user, whether Social Ambassador or Client Member.
Any use of the platform in violation of this section will result in immediate, permanent account termination and may be referred to law enforcement.
3. SESTA / FOSTA Compliance
Social Additions strictly complies with the Stop Enabling Sex Traffickers Act (SESTA) and the Fight Online Sex Trafficking Act (FOSTA). Our platform does not knowingly facilitate, and actively prohibits, any content, communications, listings, or interactions that constitute or promote sex trafficking, prostitution, or sexual solicitation of any kind.
Any content, account, listing, message, or communication that Social Additions reasonably determines promotes, solicits, advertises, facilitates, or implies sexual services — regardless of how it is framed — will be removed without notice. The account holder will be permanently banned and, where legally required or appropriate, referred to law enforcement including the National Center for Missing & Exploited Children (NCMEC) and the appropriate authorities.
Users who encounter any content they believe constitutes a SESTA/FOSTA violation must report it immediately to flag@socialadditions.com or through the reporting tools in their account.
4. Eligibility
To create an account or use Social Additions, you must:
- Be at least 21 years of age
- Be a natural person capable of entering into binding legal contracts under applicable law
- Provide accurate, truthful, and complete information when registering and at all times thereafter
- Have legal authorization to work in your jurisdiction (Social Ambassador)
- Complete identity verification as required (Social Ambassador)
- Not have been previously banned or suspended from Social Additions under any prior account
- Comply with all applicable local, state, national, and international laws while using the platform
Creating an account on behalf of another person without their explicit written consent, misrepresenting your age or identity, or creating a second account after a prior ban, are each grounds for immediate permanent termination. Social Additions reserves the right to refuse service to any person, at any time, for any reason.
5. Account Registration & Security
When creating your account, you agree to:
- Provide your real legal name, a valid email address, and accurate contact information
- Choose a strong, unique password and keep it confidential
- Maintain and promptly update your account information to keep it accurate and current
- Not share your account credentials with any other person
- Not allow any other person to use your account
- Notify us immediately at support@socialadditions.com if you suspect unauthorized access to your account
You are solely responsible for all activity that occurs under your account, whether or not authorized by you. Social Additions is not liable for any loss or damage arising from unauthorized account access resulting from your failure to maintain account security. Social Additions will never ask for your password via email, chat, or any other channel.
Each individual may hold only one account. Duplicate accounts, fake accounts, and bot accounts are prohibited and will be permanently removed. Social Additions may use technical measures to detect and prevent duplicate or fraudulent accounts.
6. Independent Contractor Status
All directory profiles are Independent Contractors.
Individuals listed on Social Additions are self-employed Independent Contractors — not employees, staff, agents, or representatives of Social Additions or MCC Network LLC. Social Additions does not employ them, direct their work, set their schedules, or control how they perform any engagement. This is a fundamental and material term of these Terms of Service.
Independent Contractors listed on Social Additions are not employees, agents, joint venturers, or partners of Social Additions or any Client Member. This classification is not subject to modification based on the nature, duration, or terms of any individual engagement.
- Full autonomy: Social Ambassadors set their own rates, hours, availability, service offerings, booking requirements, and personal limits. Social Additions does not direct, supervise, schedule, or control how Social Ambassador perform any engagement.
- No employment benefits: Social Ambassadors are not entitled to workers' compensation, unemployment insurance, health or dental insurance, paid leave, overtime, minimum wage protections, retirement benefits, or any other employment benefit from Social Additions.
- Tax responsibility: Social Ambassadors are solely and exclusively responsible for reporting and paying all applicable federal, state, and local taxes on all earnings received through the platform, including self-employment taxes, income taxes, and any applicable sales or service taxes. Social Additions may issue IRS Form 1099-NEC where required by law. Social Ambassador represent that they understand and accept this obligation and agree to indemnify Social Additions for any tax liability, penalties, or interest arising from their failure to comply.
- Equipment and expenses: Social Ambassador provide their own transportation, attire, materials, and other resources necessary to fulfill engagements. Social Additions does not reimburse expenses of any kind.
- No exclusivity: Social Ambassadors are free to work with other platforms, clients, and employers simultaneously. Social Additions does not impose any exclusivity requirement.
- No agency relationship: Social Ambassadors have no authority to make representations, warranties, or commitments on behalf of Social Additions, and Social Additions makes no representations on behalf of Social Ambassador.
- Licensing and compliance: Social Ambassadors are solely responsible for obtaining any licenses, permits, or certifications required by applicable law to provide their services in their jurisdiction.
If any governmental authority, court, or regulatory body determines that a Social Ambassador is an employee of Social Additions for any purpose, such determination applies solely to that specific legal or regulatory context and does not modify the rights, obligations, or intent of these Terms with respect to any other user or engagement.
7. User-Generated Content & Photo Policy
Social Additions allows users to upload and publish content including profile photos, bio text, experience descriptions, gig posts, business listings, reviews, and messages ("User Content"). By submitting any User Content to the platform, you agree to the following:
A. License Grant. You retain ownership of User Content you submit. By posting User Content, you grant Social Additions a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable, and transferable license to use, host, store, display, reproduce, distribute, adapt, modify (for formatting and technical purposes only), publicly perform, and publicly display your User Content — including for promotional, marketing, and operational purposes — for as long as the content is associated with the platform or our business. This license survives account deletion with respect to content that was publicly distributed or shared with other users prior to deletion, and may survive deletion in anonymized or aggregated form. You waive any moral rights in User Content to the extent permitted by applicable law.
B. Ownership Warranty. By uploading any photo, image, text, video, or other media, you represent and warrant that: (i) you own the content outright or hold all necessary rights, licenses, consents, releases, and permissions to submit it and grant the license described above; (ii) the content does not and will not infringe, misappropriate, or violate any third-party copyright, trademark, trade secret, right of publicity, right of privacy, or other intellectual property or proprietary right; (iii) all individuals identifiably depicted in any photo or media have consented to its publication on a public social platform; and (iv) you are the actual person depicted in all profile photos you submit.
C. Photo Standards — Required Compliance. All profile photos, gig images, and any other uploaded media must comply with the following:
- Photos must be tasteful, appropriate, and suitable for a professional social platform visible to general audiences
- No nudity of any kind — no bare genitalia, bare buttocks, or visible nipples regardless of gender expression
- No sexually suggestive poses, lingerie-style content, or imagery that implies, advertises, or promotes sexual or adult services
- Photos must be current, accurate, and represent the actual account holder — no stock images, AI-generated likenesses, photos of other people, or images so heavily filtered that they materially misrepresent your appearance
- No contact information, logos, watermarks, phone numbers, URLs, or social media handles embedded in or overlaid on photos
- No images depicting minors in any context
- No images depicting graphic violence, weapons, illegal substances, or illegal activity
- Images may not be used to defame, harass, or impersonate any person
Social Additions reserves the right to remove any photo or User Content that violates these standards at any time, without prior notice, and without liability to the account holder. Repeated violations will result in account suspension or permanent termination.
D. Content Moderation. Social Additions may, but is not obligated to, review, screen, edit, moderate, refuse, or remove any User Content at any time and for any reason, including content Social Additions believes violates these Terms, applicable law, or the rights of any third party. Social Additions does not guarantee that all content on the platform is reviewed before publication, and is not liable for any User Content submitted by users.
E. No Confidential Submissions. Any unsolicited ideas, product suggestions, or feedback you submit to Social Additions become Social Additions' property without compensation, attribution, or obligation.
8. DMCA / Copyright Infringement Policy
Social Additions respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe content on our platform infringes your copyright, send a written DMCA notice to info@socialadditions.com that includes all of the following:
- Your full name, mailing address, telephone number, and email address
- A statement that you are the copyright owner or are authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material with sufficient detail to locate it on our platform (URL, description, or screenshot)
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notice is accurate
- Your physical or electronic signature
Upon receiving a valid DMCA notice, Social Additions will remove or disable access to the allegedly infringing material and notify the account holder. Users who repeatedly infringe third-party copyrights will have their accounts terminated. Submitting a false DMCA notice may expose you to civil liability under 17 U.S.C. § 512(f).
If your content was removed due to a DMCA notice you believe was erroneous, you may submit a DMCA counter-notice to info@socialadditions.com containing the information required by 17 U.S.C. § 512(g)(3).
9. Prohibited Uses
You may not use Social Additions for any of the following. This list is illustrative, not exhaustive:
- Any sexual, romantic, or escort-adjacent service, solicitation, offer, or negotiation, regardless of how it is framed or described
- Human trafficking, sex trafficking, or any conduct that facilitates the exploitation, coercion, or trafficking of any person
- Posting false, deceptive, misleading, or inaccurate profile information, gig listings, reviews, or any other content
- Impersonating any person or entity, using another person's photos without their written consent, or misrepresenting your identity, age, qualifications, or services
- Uploading, posting, or transmitting spam, unsolicited commercial messages, malware, phishing links, or any harmful code
- Scraping, crawling, spidering, or automated data collection from any part of the platform without Social Additions' prior written consent
- Attempting to reverse engineer, decompile, disassemble, or extract source code from any platform component
- Interfering with, overloading, or disrupting the platform's infrastructure, servers, security systems, or network connectivity
- Creating accounts using bots, scripts, or automated systems
- Using the platform to recruit Social Ambassador or Members away to a competing platform or service
- Commercial advertising, pyramid schemes, multi-level marketing, or unsolicited solicitations unrelated to legitimate social hosting
- Using the platform for competitor intelligence gathering, market research scraping, or unauthorized commercial analysis
- Circumventing Social Additions' payment system for transactions that originated on Social Additions (see Section 13)
- Filing false, retaliatory, or malicious reports against other users
- Attempting to gain unauthorized access to other users' accounts, Social Additions' internal systems, or any connected infrastructure
- Recording any in-person or video meeting with another user without that user's explicit consent
- Sharing another user's personal information without their consent ("doxxing")
- Using the platform in any manner that could expose Social Additions to legal liability or reputational harm
Social Additions reserves the right to take any enforcement action it deems appropriate for any prohibited use, regardless of whether it is explicitly listed above.
10. Gig Board Terms
The Social Additions Gig Board is a listing service for lawful social hosting and event opportunities. It is an informational directory — not an employment board, staffing service, or guarantee of work or payment.
For Client Members posting gigs:
- You represent and warrant that the opportunity described is lawful, platonic, and fully consistent with these Terms
- You are solely responsible for the accuracy, completeness, and legality of your listing content
- You are solely responsible for payment of the agreed rate directly to Social Ambassador — Social Additions is not a party to financial transactions on the Gig Board unless otherwise explicitly stated and agreed in writing
- Social Additions does not guarantee that any listing will receive responses, or that any Social Ambassador who responds will be available, qualified, or suitable for your needs
- Gig posts that Social Additions determines are misleading, inappropriate, inconsistent with permitted use cases, or in violation of these Terms will be removed without notice and without refund
For Social Ambassadors responding to gigs:
- You respond to gig listings at your own discretion and at your own risk
- Social Additions does not screen, background check, verify, or endorse individual Client Members who post gigs
- Social Additions is not responsible for any Client Member's failure to pay, no-show, unsafe conduct, misrepresentation, or any other breach of agreed terms
- You are responsible for conducting your own due diligence — including a video introduction — before agreeing to any gig
Platform neutrality: Social Additions is not a party to any agreement, contract, or transaction formed through the Gig Board. Social Additions does not guarantee the accuracy of listings, the suitability of participants, compliance with local law, completion of any engagement, or any outcome. Social Additions's total liability in connection with any Gig Board transaction is limited as set forth in Section 19.
11. Profiles & Verification
Independent Contractors must complete identity verification before their profile is approved and goes live. Identity verification is conducted through Stripe Identity, a third-party service operated by Stripe, Inc., under their own privacy policy. Social Additions does not conduct background checks, criminal screenings, or reference verification — and does not permanently retain copies of government-issued ID documents.
Social Additions's "ID verified" designation means we have reviewed documentation that confirms the account holder's identity at the time of verification. It does not constitute a background check, criminal history screening, reference verification, character endorsement, or guarantee of any kind regarding the account holder's suitability, safety, or conduct.
All profiles must be truthful, accurate, and current:
- Real, recent photos that accurately represent your current appearance (see Section 7C)
- Accurate descriptions of your experience, interests, skills, and services offered
- Honest representation of your availability, location, and rates
- No contact information (phone numbers, emails, social media handles, or external URLs) embedded in profile text or photos
Fake profiles, stolen or AI-generated photos, material misrepresentation of any kind, or embedding contact information in profiles will result in immediate removal. You are responsible for keeping your profile current — Social Additions is not liable for user decisions made based on outdated profile information you failed to update.
Rating Standards. Social Ambassador profiles are subject to review based on platform ratings. Social Ambassadors whose average rating falls to 3 stars or below may be placed on probation, during which Social Additions may limit profile visibility, require a performance review, or suspend the profile pending improvement. Social Additions reserves the right to determine and adjust rating-based actions at its sole discretion.
Interview Availability. Active Social Ambassador profiles are expected to remain available for free intro calls or video interviews when requested by Client Members in good standing. Consistent unavailability, failure to respond to intro requests, or disabling availability without notice may result in profile suspension or removal. Social Additions reserves the right to assess and act on availability as part of platform quality standards.
Client Members must provide a valid legal name, email address, and phone number. Social Additions may require additional verification for certain booking types, tier upgrades, or at a Social Ambassador's reasonable request.
12. Bookings & Payments
How bookings work:
- Client Member contacts Social Ambassador through Social Additions and schedules a free video introduction
- Both parties agree on date, time, duration, location, itinerary, and rate before confirming
- Client Member is charged the full booking amount at confirmation — 50% is released to the Social Ambassador immediately; the remaining 50% is held and released 20 minutes after the booking's scheduled start time, allowing time to flag a no-show or issue before payment completes
Outing expenses: Client Members are responsible for covering the cost of tickets, meals, venue entry, transportation during the outing, and any other activity-related expenses incurred during a booking — in addition to the Social Ambassador's agreed hourly or flat rate. The Ambassador's rate compensates for their time and presence only; it does not include the cost of shared activities or experiences. Social Ambassadors are independent contractors responsible for factoring their own personal expenses (travel to the meeting point, parking, etc.) into their quoted rate prior to confirming. All parties are encouraged to use the platform's intro interview or messaging stage to clarify expense expectations — including activity costs, alcohol preferences, attire, and any special arrangements — before a booking is confirmed. Any deviation from this default must be expressly agreed in writing by both parties before booking confirmation.
Cancellation policy: The following policy applies to Client Member cancellations:
- Within 30 minutes of booking confirmation: Full refund, minus the booking processing fee.
- Within the Social Ambassador's cancellation window (24, 48, or 72 hours before the booking, as set per Ambassador): 50% of the total booking amount is returned to the Client Member, minus a 25% platform service charge on that amount. The Ambassador retains the 50% already released at confirmation.
Example: On a $100 booking, $37.50 is returned to the Client Member. Social Additions retains a $12.50 service charge. The Ambassador keeps the $50 received at confirmation. - Outside the cancellation window (late cancellation): No refund is issued. The booking is voided and the date is cleared on both calendars. Both parties are notified immediately.
If a Social Ambassador cancels or fails to appear for a confirmed booking, the Client Member receives a full refund. Repeated cancellations or no-shows by either party may result in account suspension or termination. Both parties are notified by email for any cancellation.
Payment processing: All payments are processed by Stripe, Inc., a third-party payment processor. By submitting payment information, you agree to Stripe's Terms of Service and Privacy Policy. Social Additions does not directly store, process, or have access to full payment card numbers, CVV codes, or PIN data. Social Additions is not responsible for Stripe's processing errors, delays, outages, or failures.
Platform service fees: Social Additions charges a service fee on transactions processed through the platform. This fee is disclosed before payment is confirmed and is non-refundable under all circumstances, including where a booking is cancelled pursuant to the cancellation policy above.
Membership and subscription fees: All membership fees — including monthly, quarterly, semi-annual, and annual subscriptions, as well as single-day pass purchases — are non-refundable. By completing a membership payment, you acknowledge that Social Additions does not issue refunds, credits, or prorated returns for any reason, including unused access time, early cancellation, account suspension for policy violations, or dissatisfaction with the platform. You may cancel a subscription at any time to stop future renewal charges, but no refund is issued for the current or any prior billing period.
Chargebacks and payment disputes: Initiating a chargeback, payment reversal, or dispute with your card issuer or payment provider for a legitimate charge is a material violation of these Terms. Social Additions reserves the right to suspend or terminate accounts associated with fraudulent chargebacks, pursue recovery of disputed amounts through lawful collections or legal proceedings, and charge fees associated with chargeback processing.
13. Non-Circumvention
If you are introduced to or connected with another user through Social Additions — including through profile browsing, the Gig Board, or the platform messaging system — you agree not to circumvent Social Additions's platform and payment infrastructure for transactions that originated on the platform. Specifically, you agree not to:
- Arrange bookings, gigs, or paid social engagements with users you discovered through Social Additions outside the platform in order to avoid Social Additions's service fees
- Solicit or accept off-platform payments for services that originated as a Social Additions connection
- Use platform messaging to share personal contact information for the primary purpose of routing future transactions off-platform
This section does not restrict organic personal relationships that develop naturally and independently after a platform connection, nor does it prevent Social Ambassadors from maintaining independent businesses outside the platform. However, systematically using Social Additions as a sourcing tool while consistently routing payments off-platform is a material breach of these Terms and will result in account termination and potential recovery of lost platform fees.
14. Code of Conduct
Every interaction on Social Additions — online and in person — is governed by mutual respect, clear communication, and firm boundaries. All users agree to:
- Treat all interactions as platonic and professional at all times
- Respect stated boundaries — no means no, always, immediately, and without negotiation
- Meet in public settings for first in-person encounters
- Not consume drugs or be excessively intoxicated during any booking or social engagement
- Not engage in, request, suggest, or offer any illegal activity
- Not pressure, coerce, manipulate, or retaliate against any other user for any reason
- Honor agreed-upon timing, location, and itinerary
- Not record any meeting — audio or video — without the explicit advance consent of all participants
- Not share photos, recordings, or personal information about other users without their explicit consent
Either party may end a booking or engagement at any time, for any reason, without explanation or penalty. Safety and comfort always come first.

15. Safety & Reporting
Your safety is the foundation everything else is built on.
- Report any issue through the flag tools in your account dashboard, or by emailing flag@socialadditions.com for conduct concerns or help@socialadditions.com for general support
- All reports are reviewed by our team as promptly as reasonably practicable
- Serious violations trigger immediate account suspension pending investigation
- We cooperate with law enforcement when required by applicable law or when user safety is at risk
- Social Additions reserves the right to disclose user information to law enforcement, without notice, where legally required or where we determine disclosure is necessary to prevent harm to any person
We strongly recommend sharing your booking details (time, location, Social Ambassador name) with a trusted friend or family member before any in-person meeting.
If you are ever in immediate danger, call 911 first. Social Additions' reporting tools are a supplement to, not a substitute for, emergency services, law enforcement, or crisis resources.
16. Third-Party Services & Links
Social Additions integrates and depends on third-party services to operate, including but not limited to: Stripe (payment processing and identity verification), Twilio (SMS communications), Mailgun (transactional email delivery), Google Analytics (anonymous usage analytics), and Hetzner (cloud server hosting). Your use of the platform means your data may be transmitted to and processed by these providers under their respective terms of service and privacy policies, which are listed in our Privacy Policy.
The platform may contain links to third-party websites, apps, or services. Social Additions does not control, and is not responsible for, the content, privacy practices, availability, or reliability of any third-party linked resource. Links are provided for convenience only and do not constitute an endorsement or recommendation. You access third-party resources at your own risk.
17. Intellectual Property
The Social Additions and Social Additions names, logos, trademarks, website design, software, interfaces, layout, original text, photographs, graphics, and all other platform content and features — excluding User Content — are owned by or licensed to Social Additions and protected by applicable U.S. and international intellectual property laws, including copyright, trademark, and trade secret law.
You may not copy, reproduce, distribute, modify, create derivative works of, publicly perform, publicly display, republish, transmit, sell, rent, or otherwise exploit any part of the platform or its proprietary content without Social Additions's express prior written permission. Unauthorized use may give rise to a claim for damages or constitute a criminal offense.
Your account grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for its intended purpose in accordance with these Terms. This license does not include any intellectual property rights in Social Additions's platform, software, or content.
18. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MCC NETWORK LLC, DOING BUSINESS AS SOCIAL ADDITIONS, PROVIDES THE PLATFORM, ALL CONTENT, FEATURES, AND SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND — EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
MCC NETWORK LLC EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION:
- Any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement
- Any warranty that the platform will be continuously available, uninterrupted, error-free, secure, or free of viruses or harmful components
- Any warranty regarding the accuracy, completeness, reliability, timeliness, or quality of any profile, gig listing, review, business listing, or User Content on the platform
- Any warranty regarding the identity, background, qualifications, character, suitability, legal status, or conduct of any user — including any person bearing the "ID verified" designation
- Any warranty that any booking, gig, social engagement, or interaction will proceed as planned, result in a satisfactory experience, or conclude safely
- Any warranty that any Social Ambassador is legally permitted to offer specific services in your jurisdiction
Social Additions's "ID verified" designation means identity documentation was reviewed at the time of application. It does not constitute a background check, criminal history search, sex offender registry check, reference verification, or endorsement of any kind. You use your own judgment and conduct your own due diligence before meeting any user in person.
19. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MCC NETWORK LLC (DBA SOCIAL ADDITIONS), ITS OWNERS, OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AFFILIATES, OR VENDORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR:
- Any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind
- Loss of profits, revenue, business opportunities, data, goodwill, or anticipated savings
- Personal injury, bodily harm, property damage, emotional distress, or any other harm arising from in-person or off-platform interactions between users
- Damages arising from unauthorized access to, or alteration or destruction of, your account or data
- Damages arising from the conduct — online or offline — of any user, whether or not previously reported to Social Additions
- Platform downtime, service interruptions, data loss, or technical failures
- Damages arising from reliance on any User Content, profile, review, gig listing, or business listing
- Damages arising from third-party services or websites linked from the platform
- Force majeure events including natural disasters, acts of government, pandemics, infrastructure failures, cyberattacks, or any event outside Social Additions's reasonable control
IN ALL CASES, MCC NETWORK LLC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU ACTUALLY PAID TO MCC NETWORK LLC IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow exclusion or limitation of certain types of damages. If you reside in such a jurisdiction, Social Additions's liability is limited to the maximum extent permitted by the law of that jurisdiction.
20. Indemnification
You agree to defend, indemnify, and hold harmless Social Additions and its owners, officers, directors, members, employees, contractors, agents, licensors, affiliates, vendors, successors, and assigns from and against any and all third-party claims, demands, losses, liabilities, damages, settlements, judgments, fines, penalties, costs, and expenses — including reasonable attorneys' fees and court costs — arising out of or relating to:
- Your access to or use of the platform
- Your User Content, including any claim that your content infringes a third party's intellectual property, privacy, or publicity rights
- Your interactions with other users, whether through the platform or in person
- Services you provide or receive through the platform or Gig Board
- Your violation of these Terms, the Community Guidelines, or any applicable law or regulation
- Your failure to pay applicable taxes, permits, or other legal obligations related to your use of the platform
- Unsafe conduct, fraud, misrepresentation, identity fraud, or illegal activity by you
- Any claim by any third party — including any governmental authority — asserting that you are an employee, agent, or representative of Social Additions
Social Additions reserves the right, at your expense, to assume exclusive control of the defense of any matter subject to indemnification by you. You agree to cooperate fully with Social Additions's defense of any such claim and not to settle any indemnified claim without Social Additions's prior written consent.
21. Dispute Resolution & Arbitration
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. You agree that the exclusive jurisdiction for any legal action not subject to arbitration shall be the state or federal courts located in Travis County, Texas, and you irrevocably consent to their personal jurisdiction.
Informal resolution first: Before initiating any legal proceeding or arbitration, the aggrieved party must contact Social Additions at info@socialadditions.com and provide written notice of the dispute. Both parties agree to negotiate in good faith for at least 30 calendar days before proceeding to arbitration.
Binding arbitration: If a dispute is not resolved informally, it shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Austin, Texas. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitrator may award the same damages as a court but may not award declaratory or injunctive relief except as expressly necessary to give effect to the arbitrator's award.
Class action and jury trial waiver: YOU AND MCC NETWORK LLC (DBA SOCIAL ADDITIONS) EACH EXPRESSLY AND IRREVOCABLY WAIVE ANY RIGHT TO: (A) BRING OR PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION; (B) BRING OR PARTICIPATE IN A PRIVATE ATTORNEY GENERAL ACTION; (C) JOIN OR CONSOLIDATE CLAIMS WITH CLAIMS OF ANY OTHER PERSON OR ENTITY; OR (D) A JURY TRIAL FOR ANY DISPUTE COVERED BY THESE TERMS. All disputes must be brought on an individual basis only.
Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
22. Platform Changes & Termination
Platform modifications: Social Additions reserves the right to modify, suspend, limit, or permanently discontinue any feature, service, or aspect of the platform — or the platform itself — at any time, with or without notice, and without liability.
Termination by Social Additions: Social Additions may suspend or terminate your account, with or without notice, at any time and for any reason, including but not limited to: violation of these Terms, suspected fraud or illegal activity, inactivity, safety concerns, or any conduct Social Additions believes poses a risk to the platform or its users. Upon termination, your right to access the platform ceases immediately. Fees paid are non-refundable upon termination for cause unless otherwise required by applicable law.
Termination by you: You may close your account at any time by contacting us at info@socialadditions.com. Closing your account does not entitle you to any refund of fees paid.
Survival: The following sections survive any termination or expiration of these Terms: Sections 1, 3, 6, 7 (A, B, D), 8, 13, 17, 18, 19, 20, 21, and any other provision that by its nature should survive termination.
23. Miscellaneous
Entire Agreement: These Terms, together with our Privacy Policy, Community Guidelines, and Rules, Reporting & Enforcement, constitute the entire agreement between you and Social Additions with respect to your use of the platform and supersede all prior agreements, representations, and understandings.
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and all remaining provisions will remain in full force and effect.
No Waiver: Social Additions's failure or delay in enforcing any provision of these Terms does not constitute a waiver of its right to enforce that provision at any time.
Assignment: You may not assign, transfer, or sublicense any rights or obligations under these Terms without Social Additions's prior written consent. Social Additions may freely assign these Terms in connection with a merger, acquisition, corporate restructuring, or sale of all or substantially all of its assets.
No Third-Party Beneficiaries: These Terms do not create any rights in or for any third party.
Force Majeure: Social Additions is not liable for any failure to perform obligations under these Terms due to causes beyond its reasonable control, including natural disasters, government actions, pandemics, cyberattacks, infrastructure failures, or internet outages.
Headings: Section headings are for convenience only and do not affect the interpretation of these Terms.
24. Changes to These Terms
Social Additions may update, modify, or replace these Terms at any time, in its sole discretion, for any reason, with or without prior notice. We will update the "Last Updated" date at the top of this page when material changes are made. Changes become effective when posted on the platform unless a later effective date is stated. Your continued access to or use of Social Additions after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to updated Terms, you must stop using the platform and may close your account.
